We collect personal data only when voluntarily submitted through our contact forms. This includes: name, email address, and any information provided in your message. We do not collect payment information directly — all transactions are processed through Stripe, our PCI-compliant payment processor.

3. Purpose of Processing

Personal data is processed solely for: responding to inquiries, delivering requested services, maintaining project communication, and fulfilling legal obligations. We do not use your data for automated decision-making or profiling.

4. Legal Basis (GDPR Article 6)

Processing is based on: (a) consent provided when submitting forms; (b) performance of a contract when engaged for services; (c) legitimate interest in responding to business inquiries.

5. Data Retention

Contact form data is retained for 24 months from last interaction. Project-related data is retained for 5 years as required by Portuguese tax law. Upon expiration, data is securely deleted or anonymized.

6. Third-Party Services

We use: Google Fonts (typography delivery), Stripe (payment processing), and Google Maps (location display). Each service operates under its own privacy policy. We do not sell or share personal data with third parties for marketing purposes.

7. Your Rights (GDPR Chapters II–III)

You have the right to: access your data, rectify inaccurate data, request erasure ("right to be forgotten"), restrict processing, data portability, object to processing, and withdraw consent at any time. To exercise these rights, contact [email protected].

8. Data Security

We implement appropriate technical and organizational measures including HTTPS encryption, secure server infrastructure, access controls, and regular security assessments to protect your personal data.

9. International Transfers

Data may be processed by third-party services (Stripe, Google) outside the European Economic Area. These transfers are protected by Standard Contractual Clauses (SCCs) and adequacy decisions where applicable.

1. Scope of Services

ModernPixelWorks provides web design, interface architecture, accessibility compliance, and related digital services. All services are delivered as described in individual project proposals and statements of work. Scope changes require written agreement and may affect pricing and timelines.

2. Project Engagement

Projects begin upon receipt of signed proposal or written confirmation. A 50% advance payment is required to initiate work. Remaining balance is due upon project completion and delivery. Late payments incur a 2% monthly surcharge after a 15-day grace period.

3. Intellectual Property

Upon full payment, all deliverables and associated intellectual property rights transfer to the client. ModernPixelWorks retains the right to display completed work in portfolios and case studies unless explicitly restricted in the project agreement.

4. Revisions

Standard projects include up to two (2) rounds of revisions per deliverable. Additional revision rounds are billed at €75/hour. Revisions must be requested within 14 days of deliverable handover.

5. Client Responsibilities

The client is responsible for: providing timely feedback, delivering required content (text, images, branding assets), granting necessary access credentials, and making decisions within agreed timelines. Delays in client response may impact project delivery schedules.

6. Limitation of Liability

ModernPixelWorks liability is limited to the total value of the project agreement. We are not liable for indirect damages, lost profits, or consequential losses. We do not guarantee specific business outcomes from design implementations.

7. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives project completion for a period of two (2) years.

8. Termination

Either party may terminate with 14 days written notice. Upon termination, client is invoiced for all work completed to date. Work-in-progress deliverables are handed over in their current state.

9. Governing Law

These terms are governed by Portuguese law. Disputes shall be submitted to the exclusive jurisdiction of the courts of Braga, Portugal.

Refund Policy

1. General Policy

ModernPixelWorks operates on a milestone-based delivery model. Refunds are evaluated based on the stage of work completion at the time of request. Work that has been completed and delivered is non-refundable.

2. Advance Payment

The initial 50% advance payment is refundable only if work has not yet commenced. Once any deliverable work has begun, the advance is non-refundable. A full refund of the advance is available within 48 hours of payment if no work has started.

3. Milestone Refunds

For projects with defined milestones, partial refunds may be issued for uncompleted milestones. Completed milestones are non-refundable. Refund calculations are based on the proportion of work completed relative to the milestone scope.

4. Cancellation by Client

Clients may cancel with 14 days written notice. Upon cancellation, an invoice is issued for all work completed to date. Any overpayment is refunded within 30 business days. Work-in-progress files are delivered in their current state.

5. Cancellation by ModernPixelWorks

We reserve the right to cancel engagements if: the client fails to provide required materials within 30 days, the client is unresponsive for 21+ consecutive days, or the project scope becomes technically unfeasible. In such cases, all payments for completed work are retained; any advance for uncompleted work is refunded.

6. Quality Disputes

If the delivered work materially deviates from the agreed scope, the client must notify ModernPixelWorks within 14 days of delivery. We will remediate at no additional cost within 10 business days. If remediation is not possible, a partial refund proportional to the affected scope will be issued.

7. Refund Processing

Approved refunds are processed within 30 business days via the original payment method. Stripe processing fees are non-refundable. Refund requests must be submitted in writing to [email protected].

8. Dispute Resolution

Refund disputes shall first be addressed through direct communication. If unresolved within 30 days, disputes may be escalated to mediation in Braga, Portugal. These terms are governed by Portuguese law.
